Vacbid aims to establish a connection between businesses and people and to enable people to fully and perfectly benefit from the services offered by businesses in line with their budget. In doing so, it works with Bid Evaluators registered with Vacbid . We have based the use of these services entirely on trust. An essential part of gaining that trust is being clear about how we use your information and protecting your right to privacy as a human being.

This Privacy Policy explains how Vacbid and its affiliates process personal information related to your use of the Vacbid Platform. Regardless of where you live, Vacbid processes your personal information in accordance with the following clauses. Please review.

1. DEFINITIONS

Undefined terms in this Privacy Policy (“ Terms ”) have the same definition as in the Terms of Service.

2. PERSONAL INFORMATION WE COLLECT

2.1 Information Required to Use the Vacbid Platform .

We collect personal information about you when you use the Vacbid Platform. Without this we may not be able to provide all requested services. This information includes:

• Contact, Account and Profile Information . Such as your name, surname, telephone number, postal address, e-mail address, date of birth and profile photo. Some of this will depend on the features you use.
• Authentication and Payment Information . Images of your government-issued identification (to the extent permitted by applicable law), your identification number or other verification information, such as a selfie taken when we verify your identity, bank account or payment account information . If you are not a Vacbid user, we may receive payment information about you, such as when a Vacbid user provides your payment card to complete a booking. If a copy of your ID is provided to us, we may scan, use and store the information contained in your ID to verify your identity and for security purposes.

2.2 Information You Choose to Provide to Us .

You may choose to provide us with additional personal information. This information may include:

• Additional Profile Information . Such as gender, preferred language( s ), city and personal description. Some of this information specified in your account settings is part of your public profile page and will be publicly available.
• Information About Others. Such as information about another person's payment instrument or co-traveler. By providing us with personal information about others, you acknowledge that you have permission to provide that information to Vacbid for the purposes described in this Privacy Policy and that you are sharing the Vacbid Privacy Policy with them.
• Address Book Contact Information .
• Other informations . For example, when you fill out a form, add information to your account, respond to surveys, post in community forums, participate in promotions , communicate with Vacbid Support and other Members, import or manually enter address book contacts, provide your address and/or share your geographic location or experience with us. If you prefer, this information may also include health information.

2.3 Information Collected Automatically Using the Vacbid Platform and Our Payment Services .

We automatically collect personal information and other information when you use the Vacbid Platform and Payment Services. This information may include:

• Geolocation Information . Depending on your device settings, such as precise or approximate location determined from your IP address, your mobile or other device's GPS , or other information you share with us. We may also collect this information when you are not using the app if you enable this through your settings or device permissions.
• Usage Information . Such as the pages or content you view, Listing searches, reservations you make, additional services you add and other transactions on the Vacbid Platform.
• Log Data and Device Information . Details of how you use the Vacbid Platform ( including whether you clicked on links to third-party applications ), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, and data before or after using the Vacbid Platform Pages you subsequently viewed or interacted with. We may collect this information even if you have not created or logged in to a Vacbid account.
• Cookies and Similar Technologies .
• Payment Transaction Information . Such as the payment instrument used, date and time, payment amount, payment instrument expiration date and billing postal code, PayPal email address, IBAN information, your address and other relevant transaction details.

2.4 Personal Information We Collect from Third Parties .

We collect personal information from other sources such as:

• Third Party Services . If you connect to or log in to the Vacbid Platform with a third-party service ( e.g. Google, Facebook, WeChat , Whatsapp ) .
• Background information . To the extent permitted by applicable law, we may obtain, for example, criminal records, sex offender registry reports, and other information about you and/or your history. We may conduct criminal background checks for Landlords in India to the extent permitted by applicable law. For Members outside the United States, we may obtain police, background or registered sex offender checks with your consent as necessary and to the extent permitted by applicable law. We may use your information, including your full name and date of birth, to obtain such reports .
• Corporate Product Invitations and Account Management . Organizations that use our enterprise products may submit personal information to facilitate account management and invitations to use enterprise products.
• Recommendations and Co-Travelers . If you are invited to the Vacbid Platform, for example as a co-traveler on a trip, the person inviting you may send personal information about you, such as your email address or other contact information.
• Other sources . To the extent permitted by applicable law, we may receive additional information about you from third-party service providers and/or partners, such as testimonials, demographic data or information to help detect fraud and security issues, and combine it with information we have. For example, we may receive background check results or fraud alerts from identity verification service providers for use in our fraud prevention, security investigation and risk assessment efforts. We may receive information about you and your activities on and off the Vacbid Platform or your experiences and interactions from our partners. We may receive health information, including but not limited to health information related to communicable diseases .

3. HOW WE USE THE INFORMATION WE COLLECT

We use personal information as set forth in this Privacy Policy.

3.1 Provide, Improve and Develop the Vacbid Platform . We may process this information for the following purposes:

• Vacbid Platform and make and receive payments,
• To enable you to communicate with other Members and Bid Evaluators,
• To process your request,
• Perform analytics, debug, and conduct research,
• Providing customer service training,
• To send you messages, updates, security alerts and account notifications,
• To process, handle or evaluate insurance claims or similar claims,
• Personalize and customize your experience based on your interactions with the Vacbid Platform, your search and reservation history, your profile information and preferences, and other content you submit; and
• To enable you to use our corporate products and accommodation services.

If you give us contact information, such as that of your friends or people you are traveling with, we may process that information for the following purposes: to facilitate your referral invitations, to share your travel details and facilitate travel planning, to detect and prevent fraud and to facilitate your requests, or for any other purpose to which you consent.

3.2 Create and Maintain a Trusted and Safer Environment . We may process this information for the following purposes:

• fraud, spam , abuse, security and safety incidents and other harmful activities,
• Consistently combating and investigating discrimination,
• Preventing fraud, conducting security investigations and risk assessments,
• To verify the information provided by you,
• Conducting checks against databases and other sources of information, including background checks ;
• To comply with our legal obligations, to protect the health and welfare of our Guests, Bid Evaluators, Bid Evaluators' employees and the public,
• resolve disputes,
• To enforce our agreements with third parties,
• Determining availability for certain booking types, such as Instant Booking,
• To comply with the law, to respond to legal requests, to prevent harm and to protect our rights,
• To enforce our terms and other policies; and
• the Vacbid Platform and information obtained from third parties.

 

3.3 Deliver, Personalize, Measure and Improve Our Advertising and Marketing . We may process this information for the following purposes:

• To send you promotional messages, marketing, advertising and other information and social media advertisements through social media platforms according to your preferences,
• To personalize, measure and improve our ads,
• Administer referral programs, rewards, surveys, sweepstakes, contests or other promotional activities or events sponsored or administered by Vacbid or its third-party partners ;
• To analyze features and preferences to send you promotional messages, marketing, advertising and other information we think may be of interest to you,
• To invite you to events and related opportunities; and
• To send promotional messages, marketing, advertising and other information that may be of interest to you according to your preferences, with your permission.

3.4 Analyzing and Sharing Your Communications.

Vacbid Platform include the purposes of fraud prevention, security investigations, risk assessment, regulatory compliance, product development, research, analysis, enforcement of our Terms of Service and customer support for the reasons set out in the "How We Use the Information We Collect" section of this policy. We use automated methods where reasonably possible. Sometimes, such as in cases of fraud investigations and customer support, we may need to manually review communications or evaluate and improve the functionality of these automated tools. We will not review, scan or analyze your messaging communications to send you third-party marketing messages, and we will not sell reviews or analysis of these communications. We may also share your communications as described in the "Sharing and Disclosure" section.

3.5 Linking Third Party Accounts.

Vacbid account to certain third-party services, such as social networks. Your contacts on these third-party services are called "Friends." When you direct data sharing by creating this connection:

• Some of the information provided to us through account linking may be published in your public profile ,
• Your activities on the Vacbid Platform may be displayed to your Friends on the Vacbid Platform and/or such third party service,
• Your Vacbid public profile may contain a link to your public profile on that third-party service,
• Other Vacbid users can see your Friends with whom you have things in common or if you are their Friend's Friend,
• Other Vacbid users can see schools, hometowns, or other groups that are partnered with them listed on your linked social networking service,
• Information you provide to us through linking your accounts may be stored, processed and transmitted for the purposes of fraud prevention, security investigations and risk assessment; and
• The publication and display of information you provide to the Vacbid Platform through this link is subject to your settings and authorizations on the Vacbid Platform and the third-party service.

3.6 Provide Payment Services. Personal information is used to enable or authorize third parties to use the Payment Services; for example:

• Detecting and preventing money laundering, fraud, abuse and security incidents, as well as conducting risk assessments,
• To comply with legal and compliance obligations (such as anti-money laundering regulations and enforcement of sanctions),
• Implementing payment policies and
• To provide and improve the Payment Services.

4. SHARING AND DISCLOSING

4.1 Sharing with Your Permission or Directive .

Where you consent, we share your information as described when you consent, such as when authorizing a third-party application or website to access your Vacbid account or when participating in promotional activities of Vacbid partners or third parties.

Where permitted by applicable law, we may use certain information about you, such as your email address, which we share with social media platforms after de-identifying you, to generate leads, drive traffic to Vacbid , or otherwise promote our products and services.

4.2 Sharing Among Members.

We may share information to facilitate bookings or other interactions between Members (who are located in or use service providers based in jurisdictions with different levels of data protection) in situations such as:

• Between Guest( s ) and Bid Evaluator( s ):
• Profile, name, names of additional Guests, cancellation history, review information, guest's age (unless prohibited by applicable law), any other information you choose to share and submit.
• profile photo and phone number is shared to help coordinate the trip .
• your profile , full name, phone number, and Listing address, will be shared with the Guest (and any additional Guests they invite) to coordinate the reservation .
• You communicate with a Member, such as your name, profile picture, and message content.
• Among the guests:
• When you, as a Guest, invite additional Guests to a reservation, certain information, such as your name, travel dates, Bid Reviewer name, Listing details, address and other relevant information, is shared with each additional Guest.

4.3 Information You Post in Profiles, Listings, and Other Public Information .

You may make certain information available to others, such as:

• profile page , which includes your profile photo, name (or initials if applicable), description, and city .
• as an approximate or exact location description of the Accommodation or Experience, calendar availability , profile photo, bulk request information, and any additional information you choose to share.
• Reviews, ratings and other general feedback.
• a community or discussion forum, blog , or social media post.

public profile and other Content you make public, such as Listing details, on third-party sites, platforms and applications.

Information you share publicly on the Vacbid Platform may be indexed through third-party search engines. In some cases, you can disable this feature in your account settings.

4.4 Host Service Providers .

Bid Evaluators may use third party services, such as cleaning services, reservations or lock providers, to help manage or deliver their services. Bid Evaluators may use features of the Vacbid Platform to share information about the Guest (such as check-in and check-out information, Guest name, Guest phone number) with such third-party service providers .

4.5 Complying with the Law, Responding to Legal Requests, Preventing Harm, and Protecting Our Rights

We may disclose your information to courts, law enforcement authorities, government or public authorities, tax authorities, authorized third parties or other Members to the extent required or permitted by law or where disclosure is reasonably necessary to: comply with our legal obligations, comply with a valid legal request (such as a subpoena or such as a court order) or to respond to claims asserted against Vacbid , to respond to a valid legal request related to a criminal investigation, to address alleged or suspected illegal activity, or to respond to other activity that may subject us, you, or our other users to legal or regulatory liability or to address, enforce, manage disputes with Members, including our Terms and other policies , or protect the rights, property or personal safety of Vacbid , its employees, Members or members of the public.

Where appropriate, we may notify Members of legal claims unless: giving notice is prohibited by legal process itself, a court order we receive, or applicable law, or we believe that giving notice would be futile or ineffective, would create a risk of injury or bodily harm to an individual or group, or would be necessary. Create or increase the risk of harm or fraud to or our Members, or subject Vacbid to a claim of obstruction of justice .

Where legally required or permitted under applicable law, we may disclose Evaluators' and/or Guests' information to tax authorities or other government agencies for the purpose of tax authorities determining appropriate compliance with applicable tax obligations. Relevant tax liabilities include Vacbid's tax liabilities for service fees, accommodation taxes and facilitation of withholding taxes, and Hosts' individual tax liabilities. Information that may be disclosed includes, but is not limited to, Bid Evaluator and Guest names, registration addresses, Bid Evaluator addresses, tax/business identification numbers, date of birth and/or contact information, property parcel identification numbers, payment information. To the extent this information is known to Vacbid , transaction dates and amounts, number of nights and Guests booked, gross and net booking value and payment amounts, taxes collected by Vacbid on behalf of Guests and the Bid Assessor.

Vacbidin facilitates or requires a Proposal Evaluator's registration, notification, permit or license application or number with a governmental authority, we may share the participating Proposal Evaluator's information with the relevant authority both during the application process and when the Registration is published.

4.6 Programs with Managers and Owners .

Bid Evaluators' and Guests' personal information, such as reservation information and information regarding compliance with applicable laws, with Bid Evaluators, management companies, homeowners associations, property owners and/or property managers (" Building Management ").

4. 7 Service Providers .

We share personal information with affiliated and unaffiliated service providers (including service providers) to help us operate our business and for compliance purposes, including those who assist us in: verifying your identity or authenticating your identity documents, checking information against public databases, providing background information controls, fraud prevention, conducting security research and risk assessments, performing product development, maintenance and debugging, allowing Vacbid Services to be provided through third-party platforms and software tools (e.g. through our APIs) . through integration ), to provide customer service, advertising or payment services, to offer additional services you select, or to review, scan and analyze communications on the Vacbid Platform for certain purposes (such as evidence of child abuse). See Analyzing and Sharing Your Communications for additional information. These providers are contractually obligated to protect your personal information and may have access to your personal information to perform these tasks. Other Members may use services other than Vacbid to process your data . These may include email or reservation management software. Such services are beyond Vacbid's control and will be subject to applicable laws with varying levels of data protection around the world.

4.8 Business Transfers .

Vacbid enters into or is involved in any merger, acquisition, reorganization, asset sale, bankruptcy or liquidation event , we may retain some or all of our assets, including your information, in connection with or in connection with such transaction. We may sell, transfer or share. In this case, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

5. OTHER IMPORTANT INFORMATION

5.1 Third Party Partners and Integrations.

of Vacbid may link to third-party services. Vacbid does not own or control these third parties. When you interact with these third parties and choose to use their services, you provide them with your information. You are subject to the privacy policies of those third parties.

6. YOUR RIGHTS

You may exercise any of the rights described in this section in accordance with applicable law. We may ask you to verify your identity and request before taking any further action regarding your request.

6.1 Managing Your Information .

You can access and update some of your personal information through your Account settings. If you have linked your Vacbid Account to a third-party service such as Facebook or Google, you can change your settings and remove the link to that service in your Account settings. It is your responsibility to keep your personal information up to date.

6.2 Data Access and Portability .

In some jurisdictions, applicable law may give you the right to request certain copies of your personal information or information about how we use your personal information, including copies of the personal information you have provided to us in a structured, commonly used and machine-readable format. You can request that we transmit this information to another service provider (where technically possible).

6.3 Data Deletion .

In some jurisdictions, you may request deletion of your personal information. If you request deletion of your personal information or if your account is suspended, terminated or voluntarily closed, please note:

• We may retain your personal information to the extent necessary for our legitimate business interests, such as anti-money laundering, detection and prevention of fraud and enhancing security. For example, if we suspend a Vacbid Account for fraud or security reasons, we may retain information from that Vacbid Account to prevent that Member from opening a new Vacbid Account in the future .
• We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, Vacbid may retain information regarding tax, legal reporting and auditing obligations.
• Information you share with others ( e.g. comments, forum posts ) may continue to be publicly visible on Vacbid even after your Vacbid Account is cancelled .
• Because we take precautions to protect data against accidental or malicious loss and destruction, remaining copies of your personal information may not be removed from our backup systems for a limited period of time.

7. SECURITY

While no organization can guarantee perfect security, we continually implement and update administrative, technical and physical security measures to help protect your information from unlawful or unauthorized access, loss, destruction or alteration.

8. CHANGES TO THIS PRIVACY POLICY

We reserve the right to change this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the "Last Updated" date at the top. In the event of material changes, we will send you notice of the change via email prior to the effective date of the change. If you do not agree to the revised Privacy Policy, you may cancel your Account. If you do not cancel your Account before the effective date of the revised Privacy Policy, your access to or use of the Vacbid Platform will be subject to the revised Privacy Policy.
